Draft Rules for HB 4888 Posted for Informal Comment, Due May 1, 2024

HB 4888, 88th Legislative, requires HHSC to reimburse Medicaid providers who provide a non-opioid treatment to a recipient under Medicaid. A provider who provides hospital outpatient department (OPD) services to a Medicaid recipient must be reimbursed separately under Medicaid for any non-opioid treatment provided as part of those services. To comply with the requirements of this bill, HHSC has amended Texas Administrative Code (TAC) section 355.8549.

HHSC is already compliant with these practices. The amended TAC rule simply documents the current process followed by HHSC, that separately reimburses Medicaid providers who provide non-opioid treatment to Medicaid recipients as part of an OPD service.

The informal comment period allows stakeholders the informal opportunity to comment on a rule before it is published in the Texas Register. This notice is to inform stakeholders that the draft rule amendment to comply with requirements created by HB 4888 has been posted.
